Can a husband give his wife the right to divorce herself indefinitely, and can this provision be included in the nikah contract, or is immediacy required?\\n\"}]}","answer":"{\"ops\":[{\"insert\":\"By consensus of all legal traditions, it is permitted for a husband to delegate the right of divorce to his wife. The basis for this is the Prophet ﷺ asking his wives to choose between remaining with him or leaving him, given the limited financial resources he could provide. In doing so, he ﷺ delegated the option to end the marriage to his wives.\\n\\nWhile all legal schools (madhāhib) agree on the general ruling, they may differ on certain details. In the Shāfiʿī school, a husband may grant his wife the right to divorce herself. This grant is considered irrevocable, because it entails a transfer of the right to initiate divorce, not merely a delegation (wakālah), which is revocable in nature.\\n\\nAs for whether immediacy is required, it depends on the husband's wording. If the husband's statement is unrestricted (muṭlaq), such as \\\"You may divorce yourself,\\\" then the wife's response must be immediate. But if the husband says, \\\"Divorce yourself whenever you want,\\\" then her response does not need to be immediate. In this case, she holds the right to divorce as long as they remain married, and the husband cannot revoke it.\\n\\nIt is important to note that in the Shāfiʿī school, this grant can only occur after the marriage contract has been concluded. Prior to that, they are not yet husband and wife, and he does not possess any right to transfer to her in the first place.\\n\\nAnd Allāh knows best.\\n\"}]}","tags":[{"_id":"668d9ffb0b76658b4c232ade","tag":"Marriage: Roles and Responsibilities","count":58},{"_id":"668d9ff10b76658b4c2329bc","tag":"Marriage: Divorce","count":27}],"createdOn":"2026-07-23T23:51:48.531Z"}
